Terms of Use
Last Updated:
These terms cover your use of the ConsultAway website. They are not the terms on which we carry out work — those are set out separately in an engagement letter, which we agree with you in writing before we act.
Who we are
This site is operated by [COMPANY LEGAL NAME], trading as ConsultAway, registered in England and Wales under company number [COMPANY NUMBER], with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ. You can reach us at [CONTACT EMAIL].
By using this website you accept these terms. If you do not accept them, please do not use the site.
Using this website
You may use the site for lawful purposes connected with considering or using our services. You agree not to:
Use it fraudulently, or to submit information you know to be false
Attempt to gain unauthorised access to any part of the site, its servers or connected systems
Introduce viruses, malicious code or anything designed to disrupt the site
Copy, reproduce, republish or redistribute our content without written permission
Use automated systems to extract content or overload the site
Misrepresent who you are or who you act for
What this website is and is not
Everything on this site is general information about what we do. It is not tax, accounting, financial or legal advice, and you should not act on it as though it were.
Advice begins when we are engaged. Until an engagement letter is in place, nothing on this site — and no figure, example or estimate on it — creates a professional relationship between us or an obligation on either side.
Assessments, estimates and outcomes
The initial assessment described on this site is provided free of charge and places you under no obligation to proceed.
Any figure we give you beforehand is an estimate based on the information available at the time. Whether a claim succeeds, and what it is finally worth, is decided by HMRC or the relevant body — not by us. We cannot and do not guarantee a particular outcome, amount or timescale, and any examples of past work shown on this site describe those cases rather than predicting yours.
Nothing is submitted in your name until you have reviewed it and told us to go ahead.
Fees
Our fees, how they are calculated and when they become payable are set out in the engagement letter agreed before we begin work. No fee arises from browsing this site or from the free assessment.
Where these terms sit
If anything in these website terms conflicts with a signed engagement letter or client agreement, that agreement takes precedence for the work it covers.
Referrals from accountants and advisers
Where a client is introduced to us by an accountant or other adviser, that introduction does not make the adviser responsible for our work, and it does not make us responsible for theirs. Any arrangement between us and an introducer is separate, and we will tell a client about it if asked.
Our content
The text, graphics, layout, branding and design of this site belong to us or are used with permission, and are protected by copyright and trade mark law. You may view and print pages for your own business use. Anything beyond that needs our written permission.
Links to other sites
Where we link to third-party websites or tools, we do so for information only. We do not control them and are not responsible for their content, security or availability.
Availability
We aim to keep the site available, but we do not guarantee it will be uninterrupted or error-free. We may suspend, withdraw or change any part of it without notice.
Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.
Subject to that, we are not liable for any loss of profit, loss of business, business interruption, or loss of anticipated savings arising from your use of this website or from reliance on information on it. This clause concerns the website; our responsibility for work we are engaged to perform is dealt with in the engagement letter.
Your information
How we handle personal information is explained in our Privacy Policy, which forms part of these terms.
Changes to these terms
We may amend these terms from time to time. The version published on this page when you use the site is the version that applies, and the date it took effect is shown above.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
